These Terms of Service (“Terms”) govern your use of UGC Cast(“Service”), hosted at https://ugccast.tech and operated by HD Digital LLP (BIN 230740039374), a company registered in the Republic of Kazakhstan.
By creating an account or using the Service you agree to these Terms.
1. The Service
UGC Cast is a platform that lets you:
- Create AI-driven blogger personas
- Generate scripts, images, voice, and short-form videos via AI
- Connect your TikTok, Instagram, and YouTube accounts via OAuth
- Publish generated videos to those platforms on your authorization
The Service is provided “as is” without warranties of fitness for any particular purpose.
2. Eligibility
You must be at least 18 years old to use the Service.
By using the Service you confirm that:
- You have the legal capacity to enter into these Terms
- You will not use the Service to violate any law or third-party rights
3. Your account
- You are responsible for keeping your password secure
- You are responsible for all activity under your account
- You must notify us immediately of any unauthorized access
- One person per account; do not share credentials
4. Your content
4.1 Ownership
You retain all rights to:
- Topics, prompts, and instructions you provide
- AI-generated content produced based on your input (within the limits imposed by the underlying AI providers)
4.2 License to operate
You grant us a non-exclusive license to store, process, and transmit your content solely for the purpose of providing the Service.
4.3 Your responsibility
You are solely responsible for:
- Ensuring your content does not infringe third-party rights (copyright, trademark, publicity rights)
- Ensuring your content complies with the rules of any platform you publish to
- Disclosing AI-generated nature of content where required by law (e.g. EU AI Act)
- Truthful representation when creating AI bloggers — do not impersonate real persons without consent
5. Acceptable use
You agree NOT to use the Service to create, generate, store, or publish:
- Content depicting real identifiable persons without their consent (deepfakes)
- Child sexual abuse material (CSAM) of any form
- Content that incites violence, harassment, or hate against any group
- Disinformation or fraudulent content (fake news, fake testimonials)
- Content that violates intellectual property rights of others
- Content that violates the published rules of any connected social platform
- Spam or content designed to manipulate platform algorithms in prohibited ways
We reserve the right to suspend accounts that violate these rules.
6. Third-party platforms
When you connect TikTok, Instagram, YouTube, or any other platform:
- You authorize us to publish content on your behalf within the scopes you grant during OAuth
- You remain bound by the terms of the connected platform
- You can disconnect at any time via the UI; we will delete stored tokens
- We are not affiliated with, endorsed by, or sponsored by TikTok, Meta, or Google
- When using TikTok features, you and we comply with the TikTok Developer Terms of Service, TikTok Terms of Service, and Community Guidelines; content that violates them must not be published through the Service
7. Billing
The Service is currently provided free of charge as a closed beta. We may introduce paid plans in the future; you will be notified before any charge.
8. AI providers and content
We rely on third-party AI providers (Google Vertex AI, fal.ai, others).
- Their availability is outside our control
- Quality of generated content may vary
- Some prompts may be rejected by the provider’s safety filters
- We pass through cost-on-submit charges from these providers as part of your usage record
9. Limitation of liability
To the maximum extent permitted by law:
- The Service is provided “as is” without warranty
- We are not liable for indirect, incidental, special, or consequential damages
- Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim (or $100 if no payments)
You agree not to hold us liable for:
- Outages or failures of third-party services (AI providers, social platforms)
- Loss of generated content due to your account deletion or platform changes
- Decisions or consequences arising from publishing AI-generated content
10. Indemnification
You agree to indemnify and hold us harmless from any claim, loss, or expense (including legal fees) arising from:
- Your violation of these Terms
- Your violation of any law or third-party right
- Content you create, generate, or publish through the Service
11. Termination
- You may terminate your account at any time via the UI
- We may suspend or terminate your account if you violate these Terms
- Upon termination we will delete your account data within 30 days, except for records we are legally required to retain
12. Changes
We may modify these Terms. Material changes will be announced via email or a notice in the Service. Continued use after the change constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the Republic of Kazakhstan, the jurisdiction in which the operator (HD Digital LLP) is registered. Disputes shall be resolved in the courts of that jurisdiction, unless a mandatory consumer-protection law of your residence applies.
